for real? the district judge is from und? wow, that sounds fishy, first they pressure chapman and remove him, now they have a und judge pressuring the standing rock, see a trend anyone? just shameful, i think every conference should blackball them!

Joe's source was close. While a flickertail is of course a Richardson's ground squirrel, a northern flicker is a bird.

Please for everyone's sake stick to news that can be validated with an online article or something of substance.
Only one of them told me that a flickertail was a bird and that was a member of the tribe that goes to college in South Dakota....

I said it seemed like a joke, I didn't come on and say I got really good sources, I just said that I talked to these people and thats what they said.... It was a conference I was at that had students from both UND and NDSU, and then when I came back one of the people that lives in my dorm that is a member of one of the tribes said that she had heard that they were changing it to the flickertails and I asked what a flickertail was and she was like a bird but they will keep the flame UND for the mean time....

Well no, there are several things you need to show in your filing, but you are correct that it is more difficult to get a preliminary injunction converted to a permanent injunction.

Nowhere in the initial settlement did it say that the tribes needed to approve DROPPING the nickname. Therefore the tribe has no standing to sue, IMO.
I haven't looked, but I believe that order may be the result of the "home town justice." I suspect the judge is a graduate of UND & UND school of law. Pure speculation, but unless they came up with some legal argument I can't come up, and that is very possible, I don't get what the basis is for the order.

One issue with the nickname is that the some of the most ardent defenders of the Sioux nickname are highly disrespectful of native Americans, so it makes the claim that the nickname is to honor native Americans ring rather hollow. That disprespect from some of the supporters doesn't go without being noticed, so it undermines support among the tribes.
