    Depending what was wrong with it, what type of repair was being done, etc. It may have been visible or may have had to be uploaded.

      One of the articles spoke of IT having to go through his data files per the coaches request and save certain files and this how they found them. With these stiffer laws on child porn, all repair people have to report to authorities whether it be desktop or lab top or phone cameras. I got the impression though not fact that his old phone was shot and they were transferring the files to a new phone. IT was snooping but doing legitment procedures on state owned property. Do not forget this cell phone belonged to MSU-Mankato

        Yeah, and when I have had PERSONAL property sent to the tech guys, they informed me that they may see files (video, pics, documents, etc.) and I should be aware of that. It could also be if he was transferring them he wanted to make sure they completely transferred and were playable.

Unless my dates are off, they found the videos on 8/14 and escorted him off the practice field several days later.           If he's innocent, what is the expectation of privacy on that school-owned cell phone? Did the tech merely come across the photos, or was he actively going through text messages, videos, photos, web history, etc?

          If he's innocent, he is going to be madder than heck when this thing gets all said and done. His choices will be to continue coaching in a town where he will be a pariah (if he doesn't get fired in this process), or try to find a job elsewhere (good luck with that).

          If he's innocent, his children will still wonder for the rest of their lives if Daddy is a pervert. Someday when his kids get married, their spouse and in-laws will find out about this mess. It will weigh on his kids for the rest of their lives - how would you like your children to be saddled with that kind of baggage?

          If something like this happened to you, and you knew in your heart of hearts you weren't this monster the school, police, and media have made you out to be, how far would you go to get compensation for your life and children's lives being completely and utterly ruined? Myself, I would go a long, long way. If he's innocent, this isn't something the school, police, and prosecutor can just say, sorry for the inconvenience, you're free to go.

          Is it possible that in the wake of the Penn State debacle, a school, small town police department, and local prosecutor could overreact to a situation like this. Before you go all naked 9 year old and fondling, remember no one is going to see and interpret these videos (thankfully) who does not have a dog in the fight - other than judge and jury if it goes that far.             Maybe one our resident attorneys could weigh in, but from watching Law & Order I have come to understand the following:

            If he goes to court, he won't be found innocent. He could be acquitted (found not guilty). Small, but significant difference in cases like this. The arrest stays on his record. Unless he gets a pardon from someone who can do that sort of thing.

            If he pleads, he will probably have to register as a sex offender and re-register every six months for the rest of his life. Fun stuff if he's actually innocent.

              What would you have done differently if you were president of the University and were presented with the videos ? The school had no control of how the legal system handled the case once they received the videos.

                Had a closed door meeting and suspended him with pay. I would have then been very hush hush on the reason for his suspension. If he was convicted obviously he would have been fired.

                If he is innocent I will bet MSU-Mankato gets sued. Publically escorting him off the field was a little drastic.

                  I completely agree with this post. He has already been convicted in a court of public opinion.

                      Agree completely. MSU-Mankato did nothing criminal but they may have harmed his reputation to an extent that it will negatively impact his earnings and it will certainly cost him legal fees. I expect he will ask for a judges opinion regarding his right to restitution and possibly punitive damages. Certainly an uncomfortable situation for all and a potential distraction for the MSU players.

                        Is it common practice to have both school issue phones and personal use phones? or do most in the profession use 1 phone for both? I guess I would be a little concerned that regardless of the reasons for having naked kids on his phone, is that its a school phone that he probably uses to contact recruits and administration and alumni. I guess I thought most have their own home cell phone for personal use so not to mix the 2.

                          When I first moved to MT...in 2007, Montana State fired Mike Kramer for what MSU essentially called his failure to police his football team. There had been a number of incidents involving law enforcement with players on the team. There wasn't much or any discipline handed out by Kramer so MSU fired him.

                          He won a fairly large settlement (200k of so) for damage to his reputation.

                          I would say it's similar to this case.

                            While it appears walking him off the practice field could have been handled differently, all that did was fuel speculation. If they would have suspended him quietly, you don't think there still would have been speculation when he didn't show up for practice? All that is moot anyway, the real damage was done when he was arrested 4 days later.

                            I really don't think the school did anything wrong.

                              The IT department discovered the videos on Aug.14. From there it went up the chain of command,thru 4 other people and then was reported to the sheriffs office on the 16th. He was suspended the next day. 3 days from discovery,deciding what they were dealing with, and a course of action, seems reasonable to me.

                                The speculation would have been there yes, but the school should not have released any information about why he was suspended. All questions should have been referred to the police.

                                If he is indeed innocent, I will be willing to bet Mankato pays him some money. Care to take that bet?

                                Montana State didn't do anything criminal when they fired Kramer yet paid him 200k because they "damaged his reputation".
