He won a fairly large settlement (200k of so) for damage to his reputation.

I would say it's similar to this case.
This coach hasn't been fired. He is suspended, with pay, pending resolution of a criminal investigation.

Montana State didn't do anything criminal when they fired Kramer yet paid him 200k because they "damaged his reputation".
The school never gave a reason for the suspension. Re-read the tweet in the first post in this thread - " MSU-Mankato FB coach arrested on child pornography charges. No wonder no one has commented since Friday when he was escorted off practice field."

There are a lot of aspects of this that are bizarre.

It took two days, and presumably multiple people having viewed and in possession of these supposedly obscene videos before someone thought to call the police? How secure was this data during this time period?

Why did they suspend him after reporting it to the sheriff's office, but prior to him being arrested/charged? Sounds like the police communicated some details of their investigation to the school? That seems like it shouldn't be happening for a whole bunch of reasons.

Why did the school have to escort him off the football field? They wait 3 days, then decide it can't wait until after practice?

I don't know about coaches, but I know lots of people who have company cell phones who use them as their personal phone as well. Much of the material they send and receive is not very professional...

The school never said why he was suspended. He also hasn't been fired.

I'll pass on your bet,i would never wager on what a court might decide. That said,if he is innocent, i'm guessing a court might look at his role in this mess before handing him money.

All i know is the geek in the IT dept. discovered the videos on the 14th. I have no idea how long he took to give it to his superior, how long HE took to pass the info up the line,etc... Some on here are complaining about an overreaction, so i have no problem with the time that was taken.

I have no idea why you think that the police might have shared info. with the school.

Once he was arrested, how he was suspended became irrelevant.

Unless msu has a policy for using school issued equipment that is not in line with professional conduct or something to that eFfect. He put msu in a tough spot just the same. And if it would get to the point he would get some sort of settlement I am sure with what happened at penn state msu would rather play it safe then sorry when its such an important and emotional subject. Not doing anything and being wrong would cause far more damage to msu imo.

He seemed to have a good record at msu so I doubt they tried to soil his name with out doing their due diligence and frankly I think it would be hard to convince a jury that msu tried to ruin his reputation. If they followed the law and school policy I think they would be in the clear and it would be a horrible horrible situation no matter how you slice it for him.

I said I would not comment until the coach has his day in court and its just as well, I am lost in this sea of banter. What two pages of comments today? Looks like everyone is back and looking forward to Sept 1 and the Jayhawks.

Exactly. Our coaches use their phones for personal use all the time. Just look at their Twitter handles.

I would imagine that many schools are rushing to get policies in place about use of school issued equipment phone video cameras etc. Imo it would be good to hammer the point use the work phone for work and the personal phone for all private matters. Something a long the lines saying if any content on the phone is found to be out of line with routine work fucntions....if anything that would appear to contain anything that would be in violation of city state and federal laws would be handed over to authorities and would be put on paid leave during any investigation into said content. something along those lines.

I guess I could care less if they're using their work phones for personal use. They need their phones by them at all times for recruiting purposes anyways.

I would be shocked if those policies aren't already in place, and have been for several years. My employer allows us to use our company cell phones for personal use. When that change was made a couple of years ago, our employee handbooks were updated accordingly so that the policies were very similar to those already in place for company computers, email, internet use, etc. regarding objectionable/illegal materials.

Found this on the Fargo Forum:

No porn found on his computer. Its really a shame when you consider his coaching record. He seems to have an ability to win.

If falsely accused, this coach may have a big legal claim, no?

Yes I would think so. The state of Minnesota should keep their check book handy.
